  13. and Protection Act, would prohibit Class B dealers (dealers who do not

  15. facilities, NOT eliminate them. (Of thousands of Class B dealers, only
  16. about 40 sell to laboratories, according to USDA).
  17.      Let me hasten to note that H.R. 594 is a good bill, well deserving
  18. everyone's attention and support.  But Liz Grayson is right to say,
  19.

  58. To amend the Animal Welfare Act to ensure that all dogs and cats used by
  59. research facilities are obtained legally.
  60.  
  61.      Be it enacted by the Senate and House of Representatives of the
  62. United States of America in
  63.      Congress assembled,
  64.  
  65. SECTION 1. SHORT TITLE.
  66.  
  67.      This Act may be cited as the `Pet Safety and Protection Act of
  68. 1997'.
  69.  
  70. SEC. 2. AMENDMENTS.
  71.  
  72.      (a) SECTION 7- Section 7 of the Animal Welfare Act (7 U.S.C. 2137)
  73. is amended to read as follows:
  74.  
  75. `SEC. 7. SOURCES OF DOGS AND CATS FOR RESEARCH FACILITIES.
  76.  
  77.      `(a) USE OF CERTAIN DOGS AND CATS- No research facility or Federal
  78. research facility may use a
  79.      dog or cat for research or educational purposes if the dog or cat
  80. was obtained from a person other than a
  81.      person described in subsection (c).
  82.  
  83.      `(b) SELLING, DONATING, OR OFFERING DOGS AND CATS- No person, other
  84. than a person
  85.      described in subsection (c), may sell, donate, or offer a dog or
  86. cat to any research facility or Federal
  87.      research facility.
  88.  
  89.      `(c) PERMISSIBLE SOURCES- Persons from whom a research facility or
  90. a Federal research facility
  91.      may obtain a dog or cat for research or educational purposes under
  92. subsection (a) and persons who may
  93.      sell, donate, or offer a dog or cat to a research facility or a
  94. Federal research facility under subsection (b)
  95.      are--
  96.  
  97.           `(1) a dealer licensed under section 3 who has bred and raised
  98. such dog or cat;
  99.  
  100.           `(2) a publicly owned and operated pound or shelter that--
  101.  
  102.                `(A) is registered with the Department of Agriculture;
  103.  
  104.                `(B) is in compliance with section 28(a)(1) and with the
  105. requirements for dealers in section
  106.                28(b) and (c); and
  107.  
  108.                `(C) obtained such dog or cat from its legal owner, other
  109. than a pound or shelter;
  110.  
  111.           `(3) a person who is donating such dog or cat and who--
  112.  
  113.                `(A) bred and raised such dog or cat; or
  114.  
  115.                `(B) owned such dog or cat for not less than 1 year
  116. immediately preceding the donation;
  117.  
  118.           `(4) a research facility licensed by the Department of
  119. Agriculture; and
  120.  
  121.           `(5) a Federal research facility licensed by the Department of
  122. Agriculture.
  123.  
  124.      `(d) PENALTIES- (1) Any person found to have violated subsection
  125. (b) shall pay $1000 for each
  126.      violation.
  127.  
  128.      `(2) Any penalty under this subsection shall be in addition to any
  129. other applicable penalty and shall be
  130.      imposed whether or not the Secretary imposes any other penalty.
  131.  
  132.      `(e) DEFINITION- For purposes of this section the term `person'
  133. includes any individual, partnership,
  134.      firm, joint stock company, corporation, association, trust, estate,
  135. pound, shelter, or other legal entity.
  136.  
  137.      `(f) CONSTRUCTION- Nothing in this section may be construed to
  138. require a pound or shelter to sell,
  139.      donate, or offer dogs or cats to research facilities or Federal
  140. research facilities.'.
  141.  
  142.      (b) SECTION 8- Section 8 of the Animal Welfare Act (7 U.S.C. 2138)
  143. is amended--
  144.  
  145.           (1) by striking `No department' and inserting in lieu thereof
  146. `Except as provided in section 7, no
  147.           department';
  148.  
  149.           (2) by striking `research or experimentation or'; and
  150.  
  151.           (3) by striking `purposes' and inserting in lieu thereof
  152. `purpose'.
  153.  
  154.      (c) SECTION 28- Section 28(b)(1) of the Animal Welfare Act (7
  155. U.S.C. 2158(b)(1)) is amended by
  156.      striking `individual or entity' and inserting in lieu thereof
  157. `research facility or Federal research facility'.
  158.  
  159. SEC. 3. EFFECTIVE DATE.
  160.  
  161.      Section 2 shall take effect three months after the date of the
  162. enactment of this Act.
